These Terms and Conditions of Sale ("Terms") govern the sale of products through the online store GoldenMaskDetectors.com ("Website").
The Website is owned and operated by Linoart Ltd., a company incorporated under the laws of the Republic of Bulgaria.
These Terms constitute the entire contractual agreement between Linoart Ltd. ("Seller") and the person placing an order through the Website ("Customer"), unless otherwise agreed in writing.
These Terms are intended to comply with the applicable legislation of the Republic of Bulgaria and the mandatory provisions of European Union consumer protection law applicable to distance sales.
Where mandatory legislation grants Consumers rights that cannot legally be excluded or limited by contract, those statutory rights shall prevail over any conflicting provision of these Terms.
The latest version of these Terms is always published on the Website.

PART I – GENERAL PROVISIONS

1. Purpose

These Terms regulate the purchase and sale of Products offered through the Website and define the respective rights and obligations of the Seller and the Customer.
They govern all contracts concluded through the Website unless expressly agreed otherwise in writing.
These Terms do not affect mandatory statutory rights granted to Consumers under applicable law.

2. Scope of Application

These Terms apply to every Order placed through the Website, irrespective of the Customer's country of residence.
Certain Products or services may additionally be subject to specific conditions, manufacturer documentation or warranty terms. Where such additional terms apply, they shall supplement these Terms without limiting any mandatory statutory rights available to Consumers.
Operational information published on the Website, including estimated delivery times, accepted payment methods, available shipping carriers and similar commercial information, forms part of the Seller's published policies where expressly referenced but does not amend these Terms unless explicitly stated.

These Terms distinguish between Consumers and Business Customers.
Certain statutory rights described in these Terms, including the legal guarantee of conformity and the statutory right of withdrawal, apply only to Consumers.
Business Customers are governed primarily by the provisions of these Terms and the applicable commercial legislation.
Where a Customer places an Order on behalf of a legal entity, the Seller may reasonably presume that the Order is made for business purposes unless the circumstances clearly indicate otherwise.

6. Acceptance of these Terms

By placing an Order through the Website, the Customer confirms that:
• they have read these Terms in full;
• they understand these Terms;
• they agree to be legally bound by these Terms;
• they have the legal capacity to conclude a binding contract.
The Customer should retain a copy of these Terms for future reference.
The Seller will make these Terms available in a durable medium upon request where required by applicable law.

7. Language of the Contract

These Terms and all Contracts concluded through the Website are drafted in the English language.
The English version constitutes the official and legally binding version of these Terms.
For the convenience of Customers, the Seller may from time to time publish translations of these Terms or other legal documents into additional languages. Such translations are provided solely for informational purposes.
In the event of any inconsistency, discrepancy or conflict between the English version and any translated version, the English version shall prevail to the fullest extent permitted by applicable law.
Nothing in this clause shall limit any mandatory rights granted to Consumers under the applicable legislation of their country of residence, including any rights concerning the language of consumer information where such rights cannot legally be waived.

8. Electronic Contract Formation and Record Retention

The Seller conducts its business electronically through the Website.
Before submitting an Order, the Customer is provided with the opportunity to review the selected Products, quantities, prices, delivery details, payment method and other information entered during the checkout process and to correct any input errors. Upon successful submission of an Order, the Seller will acknowledge receipt of the Order by electronic means. Such acknowledgement confirms only that the Order has been received and does not constitute acceptance of the Customer's offer. The sales contract is concluded only when the Seller expressly accepts the Order by dispatching the Products or by sending a separate confirmation that the Order has been accepted for fulfilment.
The Seller retains electronic records relating to concluded Contracts in accordance with applicable accounting, tax and data protection legislation. Customers may contact the Seller if they require information regarding their Order or a copy of documents that the Seller is legally required to retain.

PART II – THE WEBSITE AND PRODUCTS

9. Website

The Website is operated for the purpose of offering Products for sale to Customers in accordance with these Terms. The Seller makes reasonable efforts to ensure the continuous availability and proper functioning of the Website. However, uninterrupted access cannot be guaranteed.
The Website or any part of it may be temporarily unavailable due to maintenance, software updates, technical failures, security measures, telecommunications interruptions or circumstances beyond the Seller's reasonable control. Such temporary interruptions shall not constitute a breach of these Terms and shall not give rise to any right to compensation, except where otherwise required by mandatory law.
The Seller reserves the right to modify, suspend or discontinue any feature or functionality of the Website where reasonably necessary for operational, technical, security or legal reasons.

10. Product Information

The Seller endeavours to ensure that all Product information published on the Website is accurate, complete and up to date. Product descriptions may include, where applicable:

The Customer remains responsible for determining whether a Product is suitable for their intended purpose before placing an Order.
The Seller recommends that Customers carefully read all Product descriptions, specifications and operating instructions before purchasing.

11. Product Images

Product photographs, illustrations, videos, graphics and other visual materials are provided for illustrative purposes. Although every reasonable effort is made to present Products as accurately as possible, slight differences may occur due to:
• manufacturing updates;
• software rendering;
• lighting conditions;
• monitor calibration;
• photography techniques;
• packaging revisions.
Such differences shall not constitute a lack of conformity provided that the Product substantially corresponds to its description.

12. Availability

All Products are offered subject to availability.
The publication of a Product on the Website does not constitute a legally binding offer to sell.
Occasionally, inventory discrepancies or unforeseen supply interruptions may occur after an Order has been submitted.
Where a Product becomes unavailable before acceptance of the Customer's Order, the Seller may:
• decline the Order;
• offer an alternative Product;
• offer partial fulfilment;
• postpone dispatch by mutual agreement; or
• refund any payment received for the unavailable Product.
The Seller shall inform the Customer without undue delay of any material unavailability affecting the Order.

13. Product Specifications

Manufacturers may modify Product specifications, packaging, accessories, firmware or design without prior notice. The Seller reserves the right to update Product descriptions accordingly.
Where such changes do not materially affect the intended functionality, performance or value of the Product, they shall not constitute grounds for cancellation or compensation.

14. Compatibility

The Customer is responsible for ensuring compatibility between the purchased Product and any existing equipment owned by the Customer.
Where compatibility information is published on the Website, such information is provided in good faith based on information available from the manufacturer.
The Seller shall not be liable for incompatibility resulting from modifications performed by third parties or from use outside the intended operating conditions.

16. Age Restrictions

Certain Products offered through the Website may not be suitable for use by minors.
By placing an Order, the Customer confirms that they have the legal capacity to purchase the Products under the applicable law. The Seller reserves the right to refuse an Order where there are reasonable grounds to believe that legal age requirements are not satisfied.

17. Compliance with Local Laws

The Customer is solely responsible for ensuring that the purchase, importation, possession and use of the Products is lawful in the country, state or region where the Products will be delivered or used.
The Seller does not warrant that any Product may lawfully be imported, possessed or used in every jurisdiction.
Where shipment of a Product would violate applicable export controls, sanctions legislation or other legal restrictions, the Seller reserves the right to refuse or cancel the relevant Order.

18. Website Content and Intellectual Property

Unless otherwise stated, all intellectual property rights relating to the Website, including but not limited to:
• text;
• photographs;

19. Permitted Use of the Website

The Website is intended solely for lawful personal and legitimate commercial use relating to the purchase of Products.
The Customer shall not:
• use the Website for unlawful purposes;

• use automated systems to scrape or extract Website content without the Seller's prior written consent;
• impersonate another person or entity;
• misuse contact forms or communication channels.
The Seller reserves the right to restrict or terminate access to the Website where misuse, unlawful activity or security risks are reasonably suspected.

20. Third-Party Links

The Website may contain links to third-party websites for the convenience of Customers, including payment providers, courier services, manufacturers and other service providers.
The Seller has no control over the content or operation of such external websites and accepts no responsibility for their availability, content, privacy practices or terms of use.
Access to third-party websites is at the Customer's own risk.

21. Export Control, Sanctions and Trade Compliance

The Seller complies with all applicable export control legislation, economic sanctions, trade restrictions and customs regulations imposed by the Republic of Bulgaria, the European Union and any other applicable jurisdiction.
The Seller reserves the right to refuse, suspend or cancel any Order where fulfilment would, in the Seller's reasonable opinion, violate applicable export control laws, sanctions, embargoes or other legal restrictions.
The Seller may also refuse shipment where the destination country, consignee, payment method or intended use of the Products raises reasonable concerns regarding legal compliance.
Where an Order cannot lawfully be fulfilled for reasons beyond the Seller's control, the Seller shall refund any amount received from the Customer using the original payment method, unless otherwise required or prohibited by law.
The Seller shall not be liable for any losses arising from compliance with applicable export control or sanctions legislation.

22. Fraud Prevention and Identity Verification

The Seller is committed to preventing fraudulent transactions and protecting both Customers and the integrity of the Website. Where reasonably necessary for fraud prevention, payment verification or compliance with applicable legal obligations, the Seller may request additional information before accepting or dispatching an Order.
Such information may include, where appropriate:
• confirmation of the Customer's identity;

• additional documentation reasonably necessary to verify the legitimacy of the transaction.
The Seller may suspend processing of an Order until the requested verification has been completed.
Where the Customer fails to provide the requested information within a reasonable period, or where the Seller reasonably suspects fraud, payment abuse, identity theft, money laundering or other unlawful activity, the Seller may refuse or cancel the Order.
Any refund due following cancellation shall be made using the original payment method unless otherwise required by applicable law.
The Seller reserves the right to cooperate with payment service providers, financial institutions and competent public authorities in the investigation and prevention of fraudulent or unlawful activities.

23. Product Performance and Intended Use

The Products offered through the Website are precision electronic devices intended for metal detection and related applications. Product descriptions, technical specifications, demonstrations, instructional materials and marketing content are intended to provide general information regarding the characteristics and capabilities of the Products.
Unless expressly stated otherwise, the Seller does not guarantee that any Product will:
• detect every metal object;
• detect objects at any specific depth;
• locate valuable items;
• achieve particular search results;
• perform identically under all environmental or ground conditions;
• meet individual expectations or intended purposes of every Customer.
The performance of metal detectors depends on numerous factors beyond the Seller's control, including but not limited to:
• soil mineralisation;
• moisture content;
• electromagnetic interference;
• target size;
• target composition;
• target orientation;
• target depth;
• surrounding objects;
• search coil selection;
• detector settings;
• battery condition;
• operator experience and technique.
Statements regarding Product performance shall not be interpreted as guarantees of particular results unless expressly identified by the Seller as a contractual commitment.
Nothing in this clause limits or excludes the Consumer's statutory rights where a Product fails to conform to the Contract or does not possess the characteristics expressly described by the Seller.

24. Technical Information and Professional Advice

The Seller is committed to providing Customers with accurate and helpful information regarding the Products offered through the Website.
Product descriptions, technical specifications, user guides, setup instructions, videos, articles, frequently asked questions, email correspondence, telephone support and other informational materials are provided solely for general informational purposes and to assist Customers in the proper use of the Products.
Unless expressly agreed otherwise in writing, such information shall not constitute:
• professional advice;
• engineering advice;
• geological advice;
• archaeological advice;
• legal advice;
• environmental advice; or
• a contractual guarantee of specific performance or results.
The Customer remains solely responsible for:
• selecting Products suitable for their intended use;
• configuring and operating the Products correctly;
• reading and following the manufacturer's documentation;
• complying with all applicable laws and regulations governing the use of metal detectors in the relevant jurisdiction.
Where the Seller recommends particular settings, search coils, accessories or operating techniques, such recommendations are based on general experience and information available at the time they are provided.
Actual performance may vary depending on environmental conditions, operator experience, soil composition, electromagnetic interference and numerous other factors beyond the Seller's reasonable control.
The Seller makes no representation that any recommendation, configuration or operating technique will produce identical results for every Customer or under every operating condition.
Customers should always familiarise themselves with the official manufacturer's operating manual before using any Product. Nothing in this clause excludes or limits the Seller's liability where a Product fails to conform to the Contract, where the Seller has made an express contractual commitment, or where liability cannot lawfully be excluded under applicable legislation.

24.1 Product Recommendations

Where the Seller recommends a particular Product or accessory based on information provided by the Customer, such recommendation is made in good faith and using the Seller's experience with the Products. Unless expressly agreed in writing, recommendations are provided as general guidance only and do not constitute a guarantee that the recommended Product will satisfy every requirement, perform under all conditions, or achieve particular detection results. The Customer remains responsible for assessing whether the selected Product is suitable for their intended use.

25. Mandatory Consumer Rights

Nothing in these Terms or in any related policy limits or excludes any mandatory rights or remedies granted to Consumers under the consumer protection laws applicable to their purchase. Where mandatory legislation provides Consumers with greater protection than these Terms, the mandatory provisions of such legislation shall prevail to the extent required by law.
