1. Introduction
This Right of Withdrawal Policy ("Policy") explains the statutory right of Consumers to withdraw from distance sales contracts concluded through www.goldenmaskdetectors.com ("Website") without giving any reason.
This Policy forms an integral part of the Terms and Conditions of Sale and should be read together with:
• the Terms and Conditions of Sale;
• the Shipping Policy;
• the Warranty and Returns Policy;
• the Privacy Policy; and
• the Cookie Policy.
Nothing contained in this Policy limits or excludes any mandatory rights granted to Consumers under applicable consumer protection legislation.
2. Scope
This Policy applies only to Consumers purchasing Products through the Website.
This Policy explains the statutory right of withdrawal available to Consumers where such a right is provided by the consumer protection legislation applicable to the Contract.
Where the applicable law does not grant a statutory right of withdrawal, this Policy does not create or extend such a right unless the Seller expressly states otherwise.
It does not apply to:
• Business Customers;
• warranty claims relating to defective Products, which are governed by the Warranty and Returns Policy; or
• situations where the right of withdrawal is excluded under applicable legislation.
3. The Right of Withdrawal
Subject to the conditions set out in this Policy and applicable legislation, Consumers have the right to withdraw from a distance sales contract without providing any reason.
Where the right of withdrawal is exercised in accordance with applicable law, the Consumer is entitled to terminate the Contract and receive a refund in accordance with this Policy.
The exercise of the right of withdrawal does not require the Product to be defective.
The right of withdrawal exists independently of the Consumer's statutory rights relating to defective or non-conforming Products.
4. Withdrawal Period
Unless a statutory exception applies, the Consumer may withdraw from the Contract within 14 calendar days.
For contracts involving the sale of goods, the withdrawal period expires 14 calendar days after the day on which:
• the Consumer acquires physical possession of the Products; or
• a third party indicated by the Consumer, other than the carrier, acquires physical possession of the Products.
Where multiple Products are delivered separately under a single Order, the withdrawal period expires 14 calendar days after the Consumer or the designated third party acquires possession of the final Product.
Where Products are delivered in multiple consignments or parts, the withdrawal period expires 14 calendar days after receipt of the final consignment or part.
5. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, the Consumer must clearly inform the Seller of the decision to withdraw before the withdrawal period expires.
The Consumer may exercise the right of withdrawal by:
• using the "Withdraw from Contract" function available from a dedicated button in the website footer;
• sending an email to sales@goldenmaskdetectors.com;
• submitting a written notice;
• using the optional Model Withdrawal Form contained in this Policy; or
• making any other clear and unequivocal statement expressing the decision to withdraw from the Contract.
Where the Website provides an electronic "Withdraw from Contract" function, the Consumer may submit the withdrawal request by following the on-screen instructions. The Seller will acknowledge receipt of the withdrawal request without undue delay using a durable medium, such as email.
The Consumer is not required to use any particular wording provided that the intention to withdraw is communicated clearly.
The burden of proving that the withdrawal was exercised within the applicable period rests with the Consumer.
Accordingly, Consumers are encouraged to retain evidence that the withdrawal notice was sent.
6. Confirmation of Withdrawal
Upon receipt of a valid withdrawal notice submitted electronically, the Seller will acknowledge receipt without undue delay using a durable medium, such as email.
The acknowledgement confirms only that the withdrawal notice has been received.
It does not constitute confirmation that all statutory conditions for withdrawal have been satisfied.
7. Returning the Products
After exercising the right of withdrawal, the Consumer must return the Products to the Seller without undue delay and, in any event, no later than 14 calendar days from the date on which the withdrawal notice was communicated.
The deadline is met if the Products are dispatched before the expiry of the 14-day return period.
Products should be packaged appropriately to minimise the risk of transport damage during return shipment.
Where reasonably possible, Consumers are encouraged to include:
• the Order number;
• proof of purchase;
• all accessories supplied with the Product;
• user documentation where applicable.
The absence of original packaging does not, by itself, prevent the Consumer from exercising the statutory right of withdrawal.
8. Customer Responsibilities
Consumers are responsible only for any diminished value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Consumers are encouraged to handle Products with the same degree of care that would reasonably be permitted when examining similar Products in a physical retail shop.
The Consumer should avoid unnecessary use of the Product after deciding to exercise the right of withdrawal.
Failure to return optional accessories originally supplied with the Product may affect the amount of the refund only to the extent permitted by applicable law.
9. Diminished Value of Returned Products
The Consumer may inspect and handle the Product to determine its nature, characteristics and functioning.
However, if the Product has been handled beyond what would reasonably be permitted in a physical retail environment, the Seller may reduce the amount refunded to reflect the diminished value of the Product, where permitted by applicable law.
Examples of handling that may result in diminished value include:
• extensive outdoor use of a metal detector;
• significant wear or damage to search coils;
• use of digging tools resulting in substantial wear;
• physical modification of the Product;
• missing essential accessories;
• damage caused by improper handling after delivery.
Each returned Product will be assessed individually, taking into account its condition, functionality and the extent of any reduction in resale value.
The Seller will not impose deductions that are inconsistent with mandatory consumer protection legislation.
10. Inspection of Returned Products
Returned Products may be inspected upon receipt to verify:
• the identity of the returned Product;
• its general condition;
• completeness of the returned package;
• the presence of accessories;
• any signs of damage beyond normal inspection;
• whether any reduction in value should be applied in accordance with applicable legislation.
The inspection process is intended solely to determine the appropriate refund and does not affect the Consumer's statutory right of withdrawal where the legal conditions have been satisfied.
